Sub: Provisional discontinuation of direct recruitment to the posts of Senior Section Engineers (SSEs).

Queries have been received from some of the Railways whether provisional discontinuation of direct recruitment to the posts of Senior Section Engineers (SSEs) as provided for in Board’s letter of even number dated 25.10.2018 will have any effect on cases of inter Railway own request transfer. In this regard, it is clarified that cases of inter Railway or inter Divisional own request transfers will not be covered by the above provisional discontinuation, Subject to fulfilment of other prescribed eligibility conditions.

Central Board of Trustees, EPF recommends crediting of 8.65% rate of interest on Accumulations in the EPF Member’s Account for the year 2018-19

The 224th meeting of the Central Board of Trustees, EPF was held here today under the chairmanship of Union Minister of State for Labour and Employment (I/C) Shri Santosh Kumar Gangwar. The Central Board recommended crediting of 8.65 % rate of interest on the EPF accumulations in the EPF member’s account for the year 2018-19.

The Central Board ratified the amendment in EPF Scheme 1952, as approved in the 141st meeting of Financial Investment and Audit Committee (FIAC) held on February 12, 2019, to enable accounting of Investment in Exchange Traded Funds (ETFs) (Equity & Related Investment).

The Central Board ratified the approval of Chairman, CBT, EPF for continuation of C-DAC as a consultant to carry out the second phase of Computerisation Project. The Board gave extension to M/s Standard Chartered Bank as custodian of the EPFO securities on the existing terms and conditions of agreement for the period upto March 31, 2019. 

The Central Board approved revised estimate for the year 2018-19 and budget estimates for the year 2019-20 and recommended it to the Central Government for approval. The Board gave consent to have performance review of the Portfolio Managers from a separate agency in addition to review by M/s CRISIL Limited.

The Central Board took note of the proposal for recommendation for grant of exemption to six establishments under Section 17(2) of the EPF&MP Act, 1952 read with Para 27A of the EPF Scheme, 1952 by the Appropriate Government . The Board took note of the proposal for recommendation for grant of exemption under Section 17(2) of the EPF & MP Act 1952 read with Para 27A of the EPF Scheme,1952 to M/s Software Technology Parks of India with effect from June 05, 1994 by the Appropriate Government.

The undersigned is directed to convey approval of the competent authority to allow non­-entitled personnel of CAPFs, AR & NSG to travel by air from Jammu to Srinagar and back on official duty/ transfer/ tour and leave (on termination/commencement at base point at Jammu) as per the provisions contained in SR 48 B 4(a) subject to review after one year.

2. Approval of competent authority is also conveyed to allow non-entitled personnel of CAPFs, AR & NSG to travel by air from Delhi to Srinagar and back on official duty/transfer/tour as per the provisions contained in SR 48 B 4(a) subject to review after one year.

3. This will be effective from the date of issue of this order .

4. This issues with the concurrence of Integrated Finance Division of this Ministry vide Dy. No.CF-3452000/SS&FA(H)/2019 dated 20.2.2019 .

This is for information of all eligible Central Govt. employees/ Central Govt. Pensioners, ex-MPs and other eligible stakeholders that a Central Government Health Scheme (CGHS) Wellness Centre has started functioning at Type -III Govt. Quarters 98-100 at Kendriya Colony , Bada Lapur, Sindhoura Road , Chandmari , Varanasi from 19th February, 2019 to provide comprehensive medical facilities.

The CGHS Wellness Centre (1) at Varanasi shall cover all eligible Central Govt. Employees residing within 5 km radius of the Wellness Centre and eligible pensioners and ex-MPs , etc., living in and around Varanasi as per CGHS guidelines.

The CGHS beneficiaries shall be able to avail the CGHS facilities through the Wellness Centre from 0730 a.m. to 02.00 p.m. on all days, except Sundays and Gazzetted holidays.

The CGHS wellness Centre shall be under the administrative control of Addl Director, CGHS, Allahabad (Tel No 0532-256 0578).

A DO Letter has been revived from shri A.V.Rao, IDAS, PCDA, PCDA (O) Pune regarding timely closing of accounts on retrenchment/release of the Army Officers. It has been intimated that large number of debit balances are being reflected in IRLAs of the Army Officers on account of recovery of rent and allied charges after their date of retirement.

As per provisions of Rule 693 & 694 of RMES, “In the case of pensioners and private individuals, rent is recoverable monthly in advance. Rent bills will be sent through the appropriate MES office direct to them for payment, either into the treasury or to the MES office concerned on or before the 5th of the month” . In such a scenario, there is no need to raise a rent bill in r/o officers after retirement and PCDA (O) Pune is not required to wait for the vacation returns.

2. It is therefore, requested that rent bills of Indian Army Officers deployed at the factory and its allied establishments, may be dealt in accordance with the provisions of RMES and forwarded through Project Bhawan, if rent bill is floated at your end. A compliance report in this regard may please be forwarded to this office latest by 28/02/2019 by mail/fax.

NOTIFICATION

A new CGHS Wellness Center (D-100) will start functioning shortly at HAF Pocket -1, Sec-23 Dwarka. New Delhi. In compliance of minutes of the meeting held under chairmanship of AD (Adm) CGHS (HQ) for demarcation/rationalisation of areas covered for newly constructed CGHS Wellness Center building at Sector-23 Dwarka and rationalise some areas of CGHS WC Palam Colony & Dwarka Sec 9 (D-36A), the demarcation/rationalization is notified as under:-

Sub: Treatment of period of Leave towards minimum residency period for in-situ promotion under Modified Flexible Complimenting Scheme (MFCS)

The undersigned is directed to refer to DoPT OM of even number dated 30.07.2014 regarding the subject mentioned above. Representations have been received seeking clarifications regarding treatment of Child Care Leave as per extant instructions towards minimum residency period.

2. The matter has been examined in consultation with Department of Science and Technology and the following clarification is issued:

Clause (v) of Para 4 of OM AB 14017/32/2013-Estt.(RR) dated 30.07.2014 may be replaced with the following clauses:
“(v) Earned Leave for a total period of not exceeding 180 days (for 3 year residency period), 210 days (for 4 year residency period) and 240 days (for 5 year residency period) sanctioned as per Leave Rules shall also be taken into account while computing minimum residency period.
(va) Child Care Leave sanctioned as per Rules shall also be taken into account while computing minimum residency period”.

3. For removal of doubts, it is clarified that the above said modifications will be effective from 30.07.20 14, i.e. from the date of issue of the said OM.

Sub: Date of superannuation of doctors in case they opt to superannuate on attaining the age of 62 years.

Ref: Board's letters of even No.dated 20.09.18, 01.11.18 and 07.12.18.

Instructions have been issued vide Board's letters referred to above regarding options to be submitted by IRMS/dental doctors under the Ministry of Railways to serve on clinical posts after attaining the age of 62 years in case they wish to continue in their service upto the age of 65 years.

2. In the context of these instructions, it is clarified that such of the doctors who opt to retire at 62 years of age shall retire from service on the afternoon of the last day of the month in which they attain the age of sixty two years. Provided that a doctor whose date of birth is the first of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty-two years ."

Sub: Fixation of pay of the employees who got promoted to the post of higher Pay level after being granted the benefit of pay fixation on grant of financial upgradation under MACPS.

The issue regarding regulation of pay fixation when the promotion to a higher pay level takes place in the 7th CPC period after the employee has already availed the benefit of pay fixation on grant of Financial Upgradation under MACPS has been under consideration for quite some time. It has been decided in consultation with DoP&T that the pay fixation benefit on grant of MACP after 7th CPC may be regulated in the following manner:-

(i) Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme (as prescribed in Para 13 of RS(Revised Pay) Rules, 2016).

(ii) There shall, however, be no further fixation of pay at the time of regular promotion if it is in the same pay level as granted under MACPS.

(iii) However, at the time of actual promotion if it happens to be in a post carrying higher pay level than what is available under MACPS, then he shall be placed in the level to which he is promoted-at a cell in the promoted level equal to the figure being drawn by him on account of MACP. If no such cell is available in the level to which promoted, he shall be placed at the next higher cell in that level. The employee may have an option to get this fixation done either on the date of promotion or w.e.f. the date of next increment as per the option to be exercised by him.

विषय: उच्चतर वेतन लेवल के पद पर पदोन्‍नत किए गए कर्मचारियों को एमएसीपीएस के अंतर्गत वित्तीय अपग्रेडेशन प्रदान करने पर वेतन निर्धारण का लाभ दिए जाने के पश्चात्‌ वेतन निर्धारित करना।


उच्चतर वेतन लेवल में पदोन्‍नत किए गए कर्मचारियों को एमएसीपीएस के अंतर्गत वित्तीय अपग्रेडेशन प्रदान करने पर वेतन निर्धारण का लाभ पहले से दिए जाने के पश्चात 7वें केंद्रीय वेतन आयोग की अवधि में वेतन निर्धारण को विनियमित करने से संबंधित मामले पर पिछले कुछ समय से विचार किया जा रहा है। कार्मिक एवं प्रशिक्षण विभाग के परामर्श से यह विनिश्चय किया गया है कि 77वें केंद्रीय वेतन आयोग के पश्चात्‌ एमएसीपी प्रदान करने पर वेतन निर्धारण के लाभ निम्नानुसार विनियमित किए जाएंगे:-
  • (i) इस योजना के अंतर्गत नियमित पदोन्‍नति के समय उपलब्ध वेतन निर्धारण के लाभ वित्तीय अपग्रेडेशन के समय भी अनुमेय होंगे (आरएस (संशोधित वेतन) नियम, 2016 के पैरा 13 में यथा निर्धारित)।

  • (ii) बहरहाल, नियमित पदोन्नति के समय अगला वेतन निर्धारण नहीं होगा, यदि कर्मचारी उसी वेतन लेवल में हो, जो एमएसीपीएस के अंतर्गत प्रदान किया गया हो।

  • (iii) बहरहाल, वास्तविक पदोन्‍नति के समय, यदि एमएसीपीएस के अंतर्गत मौजूद लेवल से उच्चतर वेतन लेवल वाले पद पर ऐसी स्थिति होती है तो कर्मचारी को एमएसीपी के अनुसार लिए जा रहे वेतन के समान, पदोन्‍नति लेवल के उस सेल पर रखा जाएगा, जिस लेवल पर उसकी पदोन्नति हुई हो। यदि उक्त लेवल में ऐसा कोई सेल उपलब्ध न हो, जिस पर पदोन्नति हुई हो, तो उसे उस लेवल में मौजूद अगले उच्चतर सेल में स्थापित किया जाएगा। कर्मचारी के पास विकल्प है कि वह पदोन्नति की तारीख से वेतन निर्धारण कर सकता है अथवा उसके द्वारा दिए गए विकल्प के अनुसार अगली वेतनवृद्धि की तारीख से वेतन निर्धारण कर सकता है। .
2. इसे रेल मंत्रालय के वित्त निदेशालय द्वारा अनुमोदित किया गया है।

Subject: Special recruitment drive for recruitment of Ex-Servicemen.
The undersigned is directed to refer to Ex-Servicemen (Re-employment in Central Civil Services and Post) Rules, 1979, as amended, the last amendment having been made by DOP&T OM dated 04.10.2012, as per which 10% of the vacancies in posts up to the level of Asst Commandant in all para military forces, 10% of the vacancies in Group C posts, and 20% of vacancies in Group D posts, including permanent vacancies filled initially on a temporary basis and temporary vacancies which are likely to be made permanent or are likely to continue for 3 months and more, to be filled by direct recruitment in any year shall be reserved for being filled by ESM As per MoF (BPE) OM No. 6/55/79-BPE (GM I) dated 13.03.1980, 14.5% vacancies in Group C posts and 24.5% vacancies in Group D posts are reserved for ESM (Including 4 5% for disabled ESM/ dependents of servicemen killed in action) in CPSUs.

2 In this regard, from the half yearly reports on implementation of reservation policy for Ex-Servicemen compiled by Directorate General Resettlement (DGR), MoD from various User Organizations. it has been observed that a high percentage of jobs reserved for Ex-Servicemen stay unutilized.

3 In view of the above, Department of Public Enterprises is requested to issue instructions to all CPSEs to conduct a special recruitment drive for Ex­-Servicemen against vacancies reserved for them to make up for the deficiency in representation of ESM In the CPSEs.

Subject: Grant of Dearness Allowance to Central Government employees - Revised Rates effective from 1.1.2019.

The undersigned is directed to refer to this Ministry's Office Memorandum No. 1/2/2018-E-ll (B) dated 7th September, 2018 on the subject mentioned above and to say that the President is pleased to decide that the Dearness Allowance payable to Central Government employees shall be enhanced from the existing rate of 9% to 12% of the basic pay with effect from 1st January, 2019 .

2. The term 'basic pay' in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix as per 7th CPC recommendations accepted by the Government , but does not include any other type of pay like special pay, etc.

3. The Dearness Allowance will continue to be a distinct element of remuneration and will not be treated as pay within the ambit of FR 9(21).

4. The payment on account of Dearness Allowance involving fractions of 50 paise and above may be rounded to the next higher rupee and the fractions of less than 50 paise may be ignored.

5. The payment of arrears of Dearness Allowance (from January to March) shall not be made before the date of disbursement of salary of March, 2019.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In respect of Armed Forces personnel and Railway employees , separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

7. In so far as the employees working in the Indian Audit and Accounts Department are concerned , these orders are issued with the concurrence of the Comp r ler and Auditor General of India.

Please refer to above cited circulars under which DP&PW OM F. No. 38/37/08-P&PW (A) dt. 28.01.2013 & 38/37/08-P&PW (A) dt.30.07.2015 were circulated. In the ibid OM dated 28.01.2013 of Department of Pension & Pensioners’ Welfare, the grade pay corresponding to the pre-revised pay scale of Rs. 6500- 10500 was shown as Rs.4200/- and the minimum pension in terms of para 4.2 of the OM dated 01.09.2008 was shown as Rs.8145/- (50% of minimum pay of Rs.16,290/- as per fitment table for the pre-revised scale of pay of Rs.6500- 10500,annexed to Ministry of Finance, Department of Expenditure’s OM No.1/1/2008-IC dated 30th August,2008).

2. Order were issued vide Ministry of Finance, Department of Expenditure’s OM No. 1.1.2008-IC dated 13.11.2009 that the posts which were in the pre-revised scale of Rs.6500-10500 as on 01.01.2006 and which were granted the normal replacement pay structure of grade pay of Rs.4200/- in the pay band PB-2, will be granted grade pay of Rs.4600/- in the pay band PB-2 corresponding to the pre- revised scale of Rs.7450-11,500 wef 01.01.2006.

3. Representations have been received in Ministry of Personnel, PG & Pensions, Deptt. of P&PW for extending the benefit of grade pay of Rs.4600/- for revision of pension/family pension, wef 01.01.2006, in respect of Pre-2006 pensioners who retired/died in the 5th CPC scale of Rs.6500-10500/- or equivalent pay scale in the earlier Pay Commission periods. The matter regarding the amount of minimum pension/family pension in terms of para 4.2 of the OM dated 01.09.2008 in their case has been re-examined in the light of the orders issued by Ministry of Finance (Department of Expenditure) vide their OM No. 1/1/08-IC dated 13.11.2009 and decisions of courts in certain cases. It has been observed that pay of all serving employees in the pre-revised pay sale of Rs.6500-10500/- has been fixed wef 01.01.2006 in the grade pay of Rs.4600/-. Therefore, the grade pay of Rs.4600/- can be considered as the grade pay corresponding to the pre-revised pay scale of Rs.6500-10500/-.

4. Accordingly GOI, DP&PW has been decided vide OM No.38/33/12-P&PW(A) dt.04.01.2019 that, for the purpose of revision of pension/family pension wef 01.01.2006 under para 4.2 of the OM dated 01.09.2008, the Grade Pay of Rs. 4600/- may be considered as the corresponding Grade pay in the case of pre- 2006 pensioners who retired/died in the 5th CPC scale of Rs.6500-10500/- or equivalent pay scale in the earlier Pay Commission periods.

5. In accordance with the provisions of Rule 7 of the CCS (Revised Pay) Rules, 2008, the pay corresponding to the pay of Rs.6500/- in the pre-revised pay scale of Rs.6500-10500/- would be Rs.12090/- in the PB-2. After adding the grade pay of Rs.4600/-, the pay in the Pay Band+Grade Pay corresponding to the pay of Rs.6500/- in the pre-revised pay scale of Rs.6500-10500 would be Rs.16690/- (12090+4600). Accordingly, the revised pension wef 01.01.2006 in terms of para 4.2 of OM dated 01.09.2008, for the pre-2006 pensioners who retired from the pay scale of Rs. 6500-10500/- in the 5th CPC or equivalent pay scales in the earlier Pay Commissions would be Rs. 8345/-. Accordingly the entries at serial number 13 in the annexure of DP&PW OM No. 38/37/08-P&PW (A) dated 28.01.2013 may be substituted by the entries shown in the statement annexed to this OM. 6. As provided in DP&PW OM dated 28.01.2013, in case the consolidated pension/family pension calculated as per para 4.1 of DP&PW OM No. 38/37/08- P&PW (A) dated 01.09.2008 is higher than the pension/family pension calculated in the manner indicated above, the same (higher consolidated pension/family pension) will continue to be treated as basic pension/family pension.

7. It is requested that suitable instructions alongwith a copy of this Circular may please be issued to all sub offices under your administrative control for implementation of the above Government order.

Subject: Clarification on availability of option for fixation of pay on promotion from the Date of Next Increment (DNI) in the lower post and method of fixation of pay from DNI, if opted for , in respect of Army Pay Rules 2017, Air Force Pay Rules 2017 and Navy Pay Regulations 2017 in respect of Officers and JCOs/OR equivalent.

Reference is invited to Ministry of Defence O.M. of even No. dated 22 .3.2018 .

In this connection , it is stated that the option is to be exercised within three months from the date of promotion, to have pay fixed under these provisions from the date of such promotion or to have the pay fixed from the date of accrual of next increment in the scale of the pay in lower grade.

2. For all personnel who have been promoted in the interim period (from 01 January 2016 until the issuance of this O.M.), the option is to be exercised within six months of issuance of this O.M. Further, option for pay fixation on promotion, once exercised is final.

3. This issues with the concurrence of Defence (Finance) vide their I.D. No. 1(8)/2017-AG/PA-35 dated 05.02.2019 .

Ref: Railway Board's letter No. PC-V/97/l/7/12 (Pt.4) dated 27-9-1999 (RBE No. 242/99)

References have been received from a few Railways seeking clarification regarding grant of Transport Allowance to Railway employees availing Concessional Season Ticket/Suburban passes. In this regard it ts stated that there is no change in the instructions contained in Board's letters dated 12-9-2008 (RBE No.111/2008), 23-01-2009 (RBE No. 16/2009) and 03-8-2017 (RBE No. 84/2017). These orders do not prohibit payment of Transport Allowance to Railway employees availing Concessional Season Tickets/Suburban passes.

2. This issues with the concurrence of the Finance Directorate.
