OFFICE MEMORANDUM

Subject: Implementation on the recommendations of 7th Central Pay Commission - Grant of Island Special Duty Allowance to the Central Government employees posted in the Andaman & Nicobar Group of Islands and Islands of Union Territory of Lakshadweep.

Consequent upon the acceptance of the recommendations of Seventh. Central Pay Commission-by the Government, the President, in supersession of'all existing orders issued on the subject from time to time, is pleased to decide that Central Government employees posted in the Andaman & Nicobar (A&N) Group of islands and Islands of Union Territory of Lakshadweep, shall be paid Island Special Duty Allowance at'the following rates:-

(Port Blair in A&N Islands, Kavaratti and Agatti in Lakshadweep)
10% of Basic Pay
(ii) Difficult Areas
(North and Middle Andaman, South Andaman excluding Port Blair in A&N islands, all Islands in Lakshadweea except Kavarati, Aatti and Minicoy)
16% of Basic Pay
(iii) More Difficult Areas
(Little Andaman, Nicobar group of Islands, Narcondam Islands, East Islands in A&N Islands, Minicoy in Lakshadweep)
20% of Basic Pay:

2. The term ‘Basic Pay’ in the revised pay structure means the pay'drawn in the prescribed level in the Pay
Matrix but does not include any other type of pay like Special Pay, etc.

3.  Island Special Duty Allowance shall not be admissible during the periods of leave/training/tour etc. beyond full calendar month(s), in case, the employee is outside the Andaman & Nicobar Group of Islands and Islands of Union Territory of Lakshadweep. The allowance shall not be admissible-during suspension and joining time.

4. Island Special Duty Allowance shall be admissible in addition to Hard Area Allowance, ‘where admissible. In places where more than one Special Compensatory Allowances are admissible, the Central Government employees posted in such stations will have the option to choose the allowance which benefits them the most, i.e. Hard Area Allowance or one of  the Special Compensatory Allowances subsumed under
Tough Location Allowance ‘Category-I, II and III.

5. The orders shall take effect from 1st July, 2017.

6. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence, Services Estimates. In respect of Armed Forces personnel and Railway employees, separate orders wilt be issued by the Ministry of Defence and Ministry of Railways, respectively.

7. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Subject: Implementation of the recommendations of the 7th Central Pay Commission - Grant of Special Duty Allowance for the Central Government employees serving in the North Eastern Region and Ladakh.

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission by the. Government, the President, in supersession of all existing orders issued on the subject from time to time, is pleased to decide that Central Government employees, serving in the North Eastern Region and Ladakh, shall be paid Special Duty Allowance (SDA) at the rate of 10% of Basic Pay.

2. The term ‘Basic Pay' in the revised pay structure means the pay drawn in the prescribed Levels in the Pay Matrix but does not include any other type of pay like Special Pay, etc.

3. Special Duty Allowance will not be admissible along with Tough Location Allowance, Employees will have the additional option to avail of the benefit of Special Compensatory (Remote Locality) Allowance (SCRLA) as per 6th Central Pay Commission rates. along with Special Duty, Allowance at revised rates.

4. Special Duty Allowance shall not be admissible during the periods of leave/training/tour etc. beyond full calendar month(s), in case, the employee is outside the North-Eastern Region and Ladakh during leave/training/tour etc. The allowance shall not be admissible during suspension and joining time.

ORDER

Ministry of Railways (Railway Board) have decided to constitute a Committee to examine the issues related to revision of hourly rates of Incentive Bonus and Bonus Factors of workshop/PUs staff under CRJ pattern/GIS. The Committee will consist of the following:-

(i) Executive Director/ME(W), Railway Board – Convener
(ii) Executive Director/PC-II, Railway Board – Member
(iii) Executive Director/F(C), Railway Board – Member

2. They examine, review, evolve and recommend changes that are desirable and feasible regarding the principles that should govern the payment of incentive Bonus and Bonus Factors to workshops/PUs staff under CRJ pattern/GIS under 7th CPC revised pay structure in respect of the following categories of employees:-
  1. SSE/SE(s) in Level 7 supervising the work of staff working on the shop floor.
  2. JR.Engineers(s) in Level 6.
  3. Sr.Technician in Level 5.
  4. Tech. Gr.II in Level 4.
  5. Tech. Gr.II in Level 3.
  6. Tech. Gr.III in Level 2.
  7. Semi skilled (Unskilled in Level 1)
  8. Unskilled in-1 S (Pre-revised Scale)
3. The Committee should submit its report within six months from the date of its constitution.

4. The Headquarters of the Committee will be at New Delhi.

5. PC-VII Branch of Railway Board will be the Nodal Branch for functioning of the Committee. Therefore, all related works/issues including part. questions, RTI cases, their execution and other formalities with regard to the committee, should be dealt with by PC-VII Branch.

6. The convenor and Members of the committee will draw TA/DA as per extant Rules.

NOTIFICATION


New Delhi, 14th July, 2017

S.R.O. _____ (E).- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules, namely:-

1 .Short title and commencement:- (1) These rules may be called the Military Nursing Service Pay Rules, 2017.

(2) They shall be deemed to have come into force on the 1st day of January,2016.

2. Save as otherwise provided under these rules, these rules shall apply to all Officers in the Military Nursing Service, who were on the effective strength of their Service as on the 1st day of January, 2016, and those who join the service thereafter, and to trainee Officers who were undergoing pre-Commission training on the 1st day of January, 2016, and to those trainee Officers who join service after that date.

3.Definitions – In these rules, unless the context otherwise requires,-

a.“existing basic pay” means the pay drawn in the prescribed existing Pay Band and Grade Pay or pay in the existing scale, but does not include any other pay like Special Pay, Military Service Pay etc;

b.“existing Pay Band and Grade Pay” in relation to a Military Nursing Service Officer, means the Pay Band and the Grade Pay applicable to the rank held by the Officer as on the date immediately before the notification of these rules, in a substantive capacity;

c.”existing scale” in relation to a Military Nursing Service Officer, means the pay scale applicable to the rank held by the Officer on the date immediately before the notification of these rules;

Explanation.- For the purposes of these rules the expressions “existing Basic Pay”, “existing Pay Band and Grade Pay” and “existing scale”, in respect of a Military Nursing Service Officer who, on the 1st day of January, 2016, was on deputation out of Military Nursing Service or on leave or on foreign service, or who would have on that date officiated in one or more lower posts but for his officiating in the higher post, shall mean such Basic Pay, Pay Band and Grade Pay or scale in relation to the rank which he would have held but for his being on deputation out of Military Nursing Service or on leave or on foreign service or as the case may be, but for his officiating in that post;

d. “existing pay structure” in relation to a Military Nursing Service Officer, means the Pay Band and Grade Pay or the Pay Scale as per the Sixth Central Pay Commission applicable to the rank held by the Officer as on the date immediately before the coming into force of these rules, in a substantive capacity;

e. “existing Military Service Pay” in relation to a Military Nursing Service Officer, means the amount of Military Service Pay applicable to the rank held by him on the date immediately before coming into force of these rules;

f. existing emoluments” means the sum of (i) existing basic pay; (ii) existing Military Service Pay; and (iii)existing dearness allowance at the index average as on 1st day of January, 2016;

g. Pay Matrix” means the Matrix specified in Part A of the Schedule, with Levels of pay arranged in vertical Cells as assigned to corresponding Pay Band and Grade Pay or scale;
Note.- In any kind of calculation which attempts to work with the maximum pay of a particular level the last figure of the Level shall not be calculated and the end-points of the Level, representing the possible highest and lowest pay in that level, may not be treated as the maximum and minimum of any closed pay scale, as used to prevail prior to the implementation of the Sixth Central Pay Commission;

h. Level” in the Pay Matrix, means the Level corresponding to the existing Pay Band and Grade Pay or scale specified in the Part A of the Schedule;

i. pay in the Level” means the pay drawn in the appropriate Cell of the Level as specified in Part A of the Schedule;

j. Military Service Pay” in relation to a Military Nursing Service Officer means the Military Service Pay applicable to the rank held by him admissible on drawal of pay in the prescribed Level in the Pay Matrix;

k. “revised pay structure” in relation to a rank means the Pay Matrix and the Levels specified therein corresponding to the existing Pay Band and Grade Pay or scale of the rank;

l. “basic pay” in the revised pay structure means the pay drawn in the prescribed Level in the Pay Matrix;

m. revised emoluments” means the sum of (i) basic pay; and (ii) Military Service Pay; and.

n. “Schedule” means a Schedule annexed to these rules.

4. Level of Ranks— The Level of ranks shall be determined in accordance with the various Levels as assigned to the corresponding existing Pay Band and Grade Pay or scale as specified in the Pay Matrix. The Level in Pay Matrix corresponding to the rank of a Military Nursing Service Officer is specified in Part B of the Schedule.

5. Drawal of pay.- (1) Save as otherwise provided in these rules, an Officer shall draw pay in the Level in the revised pay structure applicable to the rank to which he is appointed in substantive capacity:

Provided that an Officer may elect to continue to draw pay in the existing pay structure, until the date on which he earns his next or any subsequent increment in the existing pay structure, or until he ceases to hold his rank or ceases to draw pay in the existing pay structure:

Provided further that in case an Officer has been placed in a higher grade pay or scale between the 1st day of January, 2016 and the date of notification of these rules on account of promotion or upgradation, the Officer may elect to switch over to the revised pay structure from the date of such promotion or upgradation, as the case may be.

Explanation.- (i) For the purpose of this clause the option to retain the existing pay structure under the provisos of this rule shall be admissible only in respect of one existing Pay Band and Grade Pay or scale.

(ii) The aforesaid option shall not be admissible to any Officer commissioned on or after the 1st day of January, 2016, and he shall be allowed pay only in the revised pay structure.

(2) (i) Military Service Pay is a compensation for the various intangible aspects linked to the special conditions of service in Army extended to Military Nursing Service Officers in the Military Nursing Service upto and including the rank of Brigadier.

(ii) Military Service Pay shall be admissible to Military Nursing Service Officers on drawal of pay in the prescribed Level in the Pay Matrix, at the rate of Rs 10,800 per

(iii) Military Service Pay shall be counted as pay for the purpose of computation of dearness allowance and pension.

6. Exercise of option.- (1) The option under the provisos to rule 5 shall be exercised in writing in the form appended to these rules so as to reach the Principal Controller of Defence Accounts (Officers), Pune within one hundred and eighty days of the date of notification of these rules, or where revision in the existing pay structure is made by any order subsequent to the date of notification of these rules, within one hundred and eighty days of the date of such order:

Provided that,-

(i) in the case of a Military Nursing Service Officer who is, on the date of such notification or, as the case may be, date of such order, out of India on leave or deputation or foreign service or active service, the said option shall be exercised in writing so as to reach the Principal Controller of Defence Accounts (Officers) within one hundred and eighty days of the date of his taking charge of his post in India; and

(ii) where a Military Nursing Service Officer is under suspension on the 1st day of January, 2016, the option may be exercised within one hundred and eighty days of the date of his return to his duty, if that date is later than the date prescribed in this sub-rule.

2.The option, along with an undertaking in the form appended to these rules, shall be intimated by the Military Nursing Service Officer to the Principal Controller of Defence Accounts (Officers).

3. If the intimation regarding option is not received by the Principal Controller of Defence Accounts (Officers) within one hundred eighty days of the date of notification of these rules, the Military Nursing Service Officer shall be deemed to have elected to be governed by the revised pay structure with effect from the 1st day of January, 2016.

4. The option once exercised shall be final.

Note 1 – Military Nursing Service Officers whose services were terminated on or after the 1st day of January, 2016 and who could not exercise the option within the prescribed time limit, on account of discharge on the expiry of the sanctioned strength, release, resignation, dismissal or discharge on disciplinary grounds, are entitled to exercise option under sub-rule (1).

Note 2 – Military Nursing Service Officers who have died on or after the 1stday of January, 2016 and could not exercise the option within the prescribed time limit, are deemed to have opted for the revised pay structure on and from the 1st day of January, 2016 or such later date is beneficial to their dependents, if the revised pay structure is more favourable and in such cases, necessary action for payment of arrears shall be taken by the Principal Controller of Defence Accounts(Officers).

Note 3.- Military Nursing Service Officers who were on Annual Leave or any other leave on the 1st day of January, 2016, which entitled them to leave salary, shall be entitled to exercise option under sub-rule (1).

7. Fixation of Pay in the Revised Pay Structure.- (1) The pay of a Military Nursing Service Officer who elects, or is deemed to have elected under rule 6 to be governed by the revised pay structure on and from the 1st day of January, 2016, shall, unless in case the President by special order otherwise directs, be fixed in the following manner, namely:-

i. the pay in the applicable Level in the Pay Matrix shall be the pay obtained by multiplying the existing basic pay by a factor of 2.57, rounded off to the nearest rupee, and the figure so arrived at shall be located in that Level in the Pay Matrix, and if such an identical figure corresponds to any Cell in the applicable Level of the Pay Matrix, the same shall be the pay, and if no such Cell is available in the applicable Level, the pay shall be fixed at the immediate next higher Cell in that applicable Level of the Pay Matrix.
ii.if the minimum pay or the first Cell in the applicable Level is more than the amount arrived at as per clause 

(i), the pay shall be fixed at the minimum pay or the first Cell of that applicable Level.

2. A Military Nursing Service Officer who is on leave on the 1st day of January, A Military Nursing Service Officer who is on leave on the 1st day of January, 2016 and is entitled to leave salary shall become entitled to pay in the revised pay structure from the 1st day of January, 2016, or the date of option for the revised pay structure.

(3) A Military Nursing Service Officer who is on Study Leave on the 1st day of January, 2016 shall be entitled to the pay in the revised pay structure from the 1st day of January, 2016, or the date of option.

(4) A Military Nursing Service Officer under suspension shall continue to draw subsistence allowance based on existing pay structure, and his pay in the revised pay structure shall be subject to the final order on the pending disciplinary proceedings.

(5) Where the existing emoluments exceed the revised emoluments in the case of any Military Nursing Service Officer, the difference shall be allowed as Personal Pay to be absorbed in future increases in pay.

(6) Where in the fixation of pay in the Pay Matrix under rule 7, the pay in the Pay Matrix of an Officer, who, in the existing pay structure was drawing immediately before the 1st day of January, 2016 more pay in the Pay Band than another Officer in the same arm or service, gets fixed in the revised pay structure at a stage lower than that of such junior, his pay in the Pay Matrix shall be stepped up to the same Cell in the revised pay structure as that of the junior.

(7) Where an Officer is in receipt of personal pay immediately before the date of notification of these rules, which together with his existing emoluments exceed the revised emoluments, then the difference representing such excess shall be allowed to such an Officer as personal pay, to be absorbed in future increase in pay.

(8) (i) in cases where a senior Officer promoted to a higher rank before the 1st day of January, 2016 draws less pay in the Pay Matrix in the revised pay structure than his junior who is promoted to the higher rank on or after the 1st day of January, 2016, the pay in the Pay Matrix of the senior Officer in the revised pay structure shall be stepped up to an amount equal to the pay in the Pay Matrix as fixed for his junior in that higher rank, and such stepping up shall be done with effect from the date of promotion of the junior Officer, subject to fulfilment of the following conditions, namely:-

(a) both the junior and senior Officers belong to the same arm or service and the rank to which they have been promoted are identical in the same arm or service;

(b) the existing grade pay and the revised Level in the Pay Matrix of the lower and higher ranks in which they are entitled to draw pay are identical;

(c) the senior Officer at the time of promotion is drawing equal or more pay than the junior;

(d) the anomaly is directly as a result of the application of the provisions of these rules or any other rule or order regulating pay fixation on such promotion in the revised pay structure:
Provided that if the junior Officer was drawing more pay in the existing pay structure than the senior Officer by virtue of any advance increments granted to him, the provisions of this rule shall not be invoked to step up the pay in the Pay Matrix of the senior Officer.

(ii) the senior Officer shall be entitled to the next increment on completion of his required qualifying service with effect from the date of re-fixation of pay.

8. Pay of Military Nursing Service Officers on successful commissioning.-

(1) On successful commissioning, the pay in the Pay Matrix of the Officer commissioned shall be fixed in first Cell of Level 10 and the period of training shall not be treated as commissioned service.

(2) In case an Officer is commissioned between the 1st day of January, 2016 and the date of notification of these rules, where the existing emoluments exceed the sum of the pay fixed in the revised pay structure and the applicable dearness allowance thereon, the difference shall be allowed as Personal Pay, to be absorbed in future increments in pay.

9. Regulation of increments in the Pay Matrix:- The increment shall be asspecified in the vertical Cells of the applicable Level in the Pay Matrix.

Illustration:


A Major in the Basic Pay of Rs. 68.000/- in Level 10B shall move vertically down the Cells in the same Level and on grant of increment, his Basic Pay shall be Rs. 70,000/-.

10. Date of increment in revised pay structure.– (1) There shall be two date10. Date of increment in revised pay structure.- (1) There shall be two datefor grant of annual increment namely, 1st January and 1st July of every year, instead of existing date of 1st July, provided that an Officer shall be entitled to only one annual increment, either on 1st January or 1st July depending on the date of his appointment or promotion or upgradation.

(2) The increment in respect of an Officer appointed or promoted or upgraded during the period between the 2nd day of January and 1st day of July (both inclusive) shall be granted on the 1st day of January and the increment in respect of an Officer appointed or promoted or upgraded during the period between the 2nd day of July and 1 stday of January (both inclusive) shall be granted on 1st day of July.

Illustration:

(a) In case of an Officer appointed or promoted or upgraded in the normal hierarchy during the period between the 2nd day of July, 2016 and the 1st day of January, 2017, the first increment shall accrue on the 1st day of July, 2017 and thereafter it shall accrue after one year on annual basis.

(b) In case of an Officer appointed or promoted or upgraded in the normal hierarchy during the period between the 2nd day of January 2016 and the 1st day of July, 2016, who did not draw any increment on 1st day of July, 2016, the next increment shall accrue on the 1st day of January, 2017 and thereafter it shall accrue after one year on annual basis:

Provided that in case of Officers whose pay in the revised pay structure has been fixed as on 1st day of January, the next increment in the Level in which the pay was so fixed as on 1st day of January, 2016 shall accrue on 1st day of July, 2016.

Provided further that the next increment after drawal of increment on 1st day of July, 2016 shall accrue on the 1st day of July, 2017.

11. Revision of pay from a date subsequent to the 1st day of January, 2016.– Where an Officer who continues to draw his pay in the existing pay structure is brought over to the revised pay structure from a date later than the 1st day of January, 2016, his pay from the later date in the revised pay structure shall be fixed in the manner prescribed in accordance with rule 7.

12. Fixation of Pay on Promotion or Upgradation on or after 1st day of January, 2016.– The fixation of pay in case of promotion or upgradation from one Level to another in the revised pay structure shall be made in the following manner, namely:-

(i) One increment shall be given in the Level from which an Officer is promoted or upgraded and he shall be placed at a Cell equal to the figure so arrived at in the Level of the rank to which promoted or upgraded, and if no such Cell is available in the Level to which promoted or upgraded, he shall be placed at the next higher Cell in that Level.

(ii) In case of promotion of an Officer from Level 12B to Level 13B, increment for promotion shall be calculated on the pay in the Level 12B being drawn immediately prior to promotion and the sum of the pay in the Level 12B plus the amount of increment for promotion plus Military Service Pay shall determine the pay in the Level 13B and the figure so arrived at will be located in the next higher Level 13B, and if such an identical figure corresponds to any Cell in Level 13B, the same shall be the pay in the revised pay structure and if the identical figure is not available in Level 13B, the pay in the Pay Matrix shall be fixed at the immediate next higher Cell in Level 13B of the Pay Matrix.

13. Pay of Officers commissioned with Ante Date for Pay on or after 1st day of January, 2016.– Pay of Officers commissioned with ante date for Pay on or after 1st day of January, 2016 shall be fixed notionally from the date of ante date in the relevant revised Level or pre revised scale as applicable and the pay shall then be arrived at as on date of commission after adding increments at the applicable rates for the period of ante date.

14. Mode of payment of arrears of Pay.– (1) The arrears, computed after deduction of subscription at enhanced rate of Defence Services Officers provident Fund with reference to the revised pay, shall be paid after deduction of adhoc arrears paid as per Government of India MoD letter No. 1(11)/2016/D(Pay/Services), dated 10th October, 2016.

Explanation.- For the purpose of this rule, “arrears of pay” in relation to an Officer, means the difference between.-

(i). the aggregate of the pay and dearness allowance, and Military Service Pay to which he is entitled on account of the revision of his pay under these rules for the period effective from the 1st day of January, 2016; and

(ii) the aggregate of the pay and dearness allowance, and Military Service Pay to which he would have been entitled (whether such pay and Dearness Allowance had been received or not) for that period had his pay and dearness allowance not been so revised.

15. Overriding effect of rules.- The provisions of the Pay and Allowances Regulations (Officers), Army 1954, and existing instructions and regulations shall not save as otherwise provided under these rules, apply to cases where pay is regulated under these rules, to the extent they are inconsistent with these rules and these rules shall supersede SAI 4/S/2008 except as respects things done or omitted to be done before such supersession.

16. Power to relax.- Where the President is satisfied that the operation of all or any of the provisions of these rules shall cause undue hardship in any particular case, he may, by order, dispense with or relax the requirements of that provision to such extent and subject to such conditions as he may consider necessary for dealing with the case in a just and equitable manner.

17. Interpretation.- If any question arises relating to the interpretation of any of the provisions of these rules, it shall be referred to the Central Government for decision.

Explanatory Memorandum— The Seventh Central Pay Commission has been implemented with effect from the 1st day of January, 2016. Likewise, the Defence Personnel of the Union of India are eligible for Seventh Central Pay revision with effect from the 1st day of January, 2016. Accordingly, these Rules have been given retrospective effect with effect from the 1st day of January, 2016. It is hereby, certified that by giving retrospective effect to these rules no one will be adversely affected.

This rate will be in force w.e.f. 1st July, 2017. The funds concerned are:-

Will the Minister of FINANCE be pleased to satate :-

(a) whether Government has implemented the recommendations of Seventh CPC regarding allowances w.e.f. 1st July, 2017 instead of 1st January, 2016;

(b) if so, the reasons and rationale therefor;

(c) the reasons for denying allowances from 1st January 2016 or from the date of announcement for implementation of enhanced basic pay under 7th CPC and arrears thereof;

(d) whether Government will review it and implement enhanced allowances w.e.f. 1st January, 2016;

(e) if so, the details thereof; and

(f) if not, the reasons therefor along with the reasons for lowest hike in Pay Commission since last 70 years?

(a) to (c): As per the established practice relating to implementation of earlier Central Pay Commission’s recommendations on allowances, the recommendations of the Seventh Central Pay Commission (7th CPC) on allowances have been implemented prospectively with effect from 01.07.2017.

In view of significant departure from the existing provisions relating to allowances as recommended by the 7th CPC and representations received in this regard, recommendations of the 7th CPC on allowances were referred to a Committee by the Government. After taking into account the recommendations of the Committee on Allowances which submitted its Report on 27.04.2017, the recommendations were approved by the Government on 28.06.2017.

(d) to (f): There is no proposal for revision of the date of implementation of recommendation on allowances. The hike is based on the recommendation of the 7th CPC on allowances, which is commensurate with the rise in Dearness Allowance as has been mentioned by the 7th CPC at Para 8.2.5 (4) of its Report.

क्या वित्त मंत्री यह बताने की कृपा करेंगे कि:

(क) क्या सरकार ने भत्तों के संबंध में सातवें केन्द्रीय वेतन आयोग की सिफारिशों को 1 जनवरी, 2016 के बजाए 1 जुलाई, 2017 से कार्यान्वित किया है

(ख) यदि हां, तो इसके कारण और औचित्य क्या हैं

(ग) सातवें केन्द्रीय वेतन आयोग के अंतर्गत भत्तों को 1 जनवरी, 2016 से अथवा वर्धित मूल वेतन के कार्यान्वयन की घोषणा की तारीख से न देने तथा तत्संबंधी बकाया नहीं दिए जाने के कारण क्या हैं

(घ) क्या सरकार इसकी समीक्षा करेगी और वर्धित भत्तों को 1 जनवरी, 2016 से लागू करेगी

(ड) यदि हां, तो तत्संबंधी ब्यौरा क्या है, और 

(च) यदि नहीं, तो इसके क्या कारण हैं और विगत 70 वर्षों में वेतन आयोग द्वारा सबसे कम वृ​द्धि किए जाने के कारण क्या हैं?

वित्त मंत्रालय में राज्य मंत्री (श्री अर्जुन राम मेघवाल)

(क) से (ग): भत्तों के संबंध में पिछले केन्द्रीय वेतन आयोगों की सिफारिशों को लागू किए जाने से संबंधित स्थापित परम्परा के अनुसार, भत्तों के संबंध में सातवें केन्द्रीय वेतन आयोग की सिफारिशें भावी प्रभाव से 01.07.2017 से लागू की गई हैं।

भत्तों से संबंधित विद्यमान प्रावधानों में सातवें केन्द्रीय वेतन आयोग द्वारा यथा—संस्तुत सार्थक बदलाव और इस संबंध में प्राप्त अभ्यावेदनों को ध्यान में रखते हुए, भत्तों के संबंध में सातवें केन्द्रीय वेतन आयोग की सिफारिशें सरकार द्वारा एक समिति को भेजी गई थीं। भत्तों से संबंधित समिति जिसने अपनी रिपोर्ट 24.07.2017 को प्रस्तुत कर दी थी, ​की सिफारिशों को ध्यान में रखते हुए सरकार द्वारा ये सिफारिशें 28.06.2017 को अनुमोदित की गई।

(घ) से (च): भत्तों से संबंधित सिफारिशों को लागू करने की तारीख में संशोधन किए जाने का कोई प्रस्ताव नहीं है। यह वृद्धि भत्तों के संबंध में सातवें केन्द्रीय वेतन आयोग की सिफारिशों पर आधारित है जो महंगाई भत्ते में वृद्धि के अनुरूप है जैसा कि सातवें केन्द्रीय वेतन आयोग द्वारा अपनी रिपोर्ट के पैरा 8.2.5(4) में उल्लेख किया गया है।

OFFICE MEMORANDUM

Subject: Grant of Fixed Medical Allowance (FMA) to the Central Government Pensioners residing in areas not covered under CGHS.

The undersigned is directed to say that at present Fixed Medical Allowance (FMA) is granted to the Central Government pensioners/family pensioners residing in areas not covered under Central Government Health Scheme administered by the Ministry of Health & Family Welfare and corresponding health schemes administered by other Ministries/Departments for their retired employees for meeting expenditure on their day-to-day medical expenses that do not require hospitalization. Orders were issued vide this Department's O.M. No. 4/25/2008-P&PW(D) dated 19-11-2014 for enhancement of the amount of Fixed Medical Allowance from Rs. 300/- to Rs. 500/- per month w.e.f. 19.11.2014.

2. Consequent upon the decision taken by the Government on the recommendations of the 7th Central Pay Commission on Allowances (with modifications), sanction of the President is hereby conveyed for enhancement of the amount of Fixed Medical Allowance from Rs.500/- to Rs.1000/- per month. The other conditions for grant of Fixed Medical Allowance shall continue to be as contained in this Department’s OMs No. 45/57/97-P&PW(C) dated 19.12.1997, 24.8.1998, 30.12.1998, 18.8.1999 and OM No. 4/25/2008-P&PW(D) dated 19.11.2014.

3. These orders will take effect from 01.07.2017.

4. In their application to the persons belonging to the Indian Audit and Accounts Department, these orders issue in consultation with the Comptroller and Auditor General of India vide their UO No. 169-Staff (Rules)/A.R/Ol-2016 dated 18.07.2017.

5. These orders are issued with the concurrence of the Ministry of Finance (Deptt. of Expenditure) vide their OM No. 11-1/2016-IC dated 11.07.2017.

The undersigned is directed to refer to this Departments' OM. No. 19024/1/2005-E.IV dated 24.03.2006, OM. No. 19024/1/2009-E.IV dated 16.09.2010 and OM. No. 19024/1/2012-E.IV dated 09.07.2013 regarding guidelines on Air travel. As per these guidelines, in all cases of Air Travel where the Government of India bears the cost of air passage, Air Tickets may be purchased directly from Airlines (at Booking counters/office/website of Airlines) and if needed, by utilizing the services of three Authorized Travel Agents viz. M/s Balmer Lawrie & Company Limited (BLCL), M/s Ashok Travels & Tours (ATT) and Indian Railways Catering and Tourism Corporation Ltd. (lRCTC).

2. This Department is receiving a large number of proposals from various Ministries/Departments seeking ex-post-facto relaxation of the prescribed procedure for purchase of air tickets from authorized travel agents only.

3. The matter has been reconsidered in this Department. All Ministries/Departments are again directed to:

(i) Ensure strict compliance of extant guidelines for purchase of air ticket directly from Airlines (at Booking counters/office/Website of Airlines) or from three authorized Travel Agents viz. M/s Balmer Lawrie & Company Limited, M/s Ashok Travels & Tours and IRCTC only by all officials/offices under their control. Henceforth relaxation on account of ignorance/unawareness of these guidelines will not be considered by this Department.

ii) In case of non-availability of authorized agent at a particular place, ticket may be booked from website of Airlines or web portal of Balmer Lawrie & Company Ltd., M/s Ashok Travels & Tours and lRCTC.

iii) In respect of Non-officials of Committees/Boards/Panels, the concerned Ministry/Department have to mention in the meeting notice that the Non-official Member has to purchase the ticket from authorized travel agent only otherwise his claim will not be settled by that Ministry/Department.

iv) All Ministries/Departments of the Government of India, etc. have to widely circulate this OM. in all offices including attached/subordinate offices/ autonomous bodies under their control with specific instructions to Heads of Departments concerned for strict compliance of these guidelines. Non-compliance of these guidelines by Ministries/Departments will be treated as lapse on the part of the concerned Ministry/Department.

Subject: Revision of pension of Pre-2016 pensioners / family pensioners in implementation of Government’s decision on the recommendations of the 7th Central Pay Commission-Concordance tables- regarding.

The undersigned is directed to refer to this Department’s OM of even number dated 12.05.2017 on the above subject and to say that instructions were issued for revision of pension / family pension with effect from 01.01.2016 in respect of Central civil pensioners / family pensioners who retired/died prior to 01.01.2016 by notionally fixing their pay in the pay matrix recommended by the 7th Central Pay Commission in the level corresponding to the pay in the pay scale / pay band and grade pay at which they retired / died. It was provided that 50% of such notional pay shall be the revised pension and 30% of the notional pay shall be the revised family pension w.e.f. 01.01.2016.

2. It was also provided that the revision of pension will be done by notional pay fixation under each intervening Pay Commission based on the formula for revision of pay. Based on the fitment tables provided by the Department of Expenditure, concordance tables for fixation of notional pay and pension / family pension of employees who retired/died in various grades during the 4th, 5th and 6th Pay Commission periods have been prepared and the same are enclosed herewith. In the case of those employees who retired/died before 01.01.1986, these concordance tables may be used based on their notional pay as on 01.01.1986, which was fixed in accordance with this Department’s OM No. 45/86/97-P&PW(D)(iii) dated 10.02.1998.

3. Separate tables have been given in respect of pre- 01.01.2016 pensioners who retired in the Group ‘D’ pay scales corresponding to 6th CPC grade pay of Rs. 1300/-, Rs. 1400/-, Rs. 1600/- and Rs. 1650/- (Table No. 1 to Table No. 4) and for pensioners who retired during 6th CPC period after upgradation to the Grade pay of Rs. 1800/- (Table No. 5 to Table No. 8). The pension/family pension of such pensioners/family pensioners may be revised using the appropriate Table.

4. These concordance tables have been prepared to facilitate revision of pension of pre-2016 pensioners/family pensioners by the concerned pension sanctioning authorities. Due care has been taken to prepare these concordance tables based on the fitment tables for fixation of pay from 4th to 5th, 5th to 6th and 6th to 7th Pay Commission. In case of any inconsistency in the concordance tables vis-a-vis the relevant rules/instructions, the notional pay and pension/family pension of pre-2016 pensioners/family pensioners may be fixed in accordance with the rules/instructions applicable for fixation of pay in the intervening Pay Commission periods.

5. It is requested that the pension of pre-2016 pensioners / family pensioners may be revised w.e.f. 01.01.2016 in accordance with the instructions contained in this Department’s OM of even no dated 12.05.2017 and using the concordance tables enclosed herewith.

OFFICE MEMORANDUM

Subject:- Implementation of the recommendations of 7th Central Pay Commission - Additional HRA for civilian employees of the Central Government serving in the States of North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and Ladakh.

Consequent upon revision of the rates of HRA granted to the Central Government employees on implementation of the recommendations of 7th Central Pay Commission vide O.M. No. 2/5/2017 E.II(B) dated 07.07.2017, in modification of this Ministry’s O.M. No. 11016/1/E.II(B)/84 dated 29.03.1984 and GM. No. 2(19)/E.II(B)/2008 dated 02.01.2009 on the subject mentioned above, additional HRA shall be granted to the civilian employees of the Central Government posted to States of North Eastern Region, Andaman & Nicobar Islands, Lakshadweep Islands and Ladakh, who leave their families behind at “their old duty station at revised rates as per OM. No. 27512017-E.II(B], dated 07.07.2017.

2. These orders, will not be applicable to such employees who were transferred out, of North Eastern Region, Andaman & Nicobar Islands and Lakshadweep Islands and Ladakh before 1 7.2017.

3. These orders shall take effect from 1st July, 2017.

4. These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the expenditure will be chargeable to the relevant head of the Defence Services Estimates. In regard to Armed Forces personnel and Railway employees, Separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

5. In so far as the employees working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission by the Government, the President, is pleased to decide that, in modification of this Ministry's -O.M. No. 20011/5/73-E.II(B) dated.17.01.1975 as amended from time to time and OM. No. 6(3)/2008-E.II(B) dated 29.08.2008 on the subject mentioned above, the Central Government employees shall be paid Project Allowance, which has been covered in the Risk/Hardship Matrix, at the following revised rates:-

These orders shall also apply to the. civilian employees paid from the Defence Services Estimates and the expenditure will be charge-able to the relevant head of the Defence Services Estimates in regard to Armed Forces personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways, respectively.

9. In so far as the employees. working in the Indian Audit and Accounts Department are concerned, these orders are issued with the concurrence of the Comptroller and Auditor General of India.

Subject:- Implementation of the recommendations of 7th Central Pay Commission - Grant of Special  Compensatory Allowances subsumed under Tough Location Allowance. 

Consequent upon the acceptance of the recommendations of Seventh Central Pay Commission, in supersession of the existing orders for grant of Special Compensatory Allowances viz. Special Compensatory (Remote  Locality) Allowance, Bad Climate Allowance, Special Compensatory Scheduled/Tribal Area Allowance and Sunderban  Allowance which have been subsumed in Tough Location Allowance, the President is pleased to decide the rates of  these Special Compensatory Allowances (subsumed in Tough Location Allowance) to Central Government employees  as under:-

2.  These rates shall increase by 25 per cent whenever the Dearness Allowance payable on the revised pay

5 Sunderban Allowance categorised 'as Tough Location Allowance-III shall be admissible to the Central Government civilian employees working in Sunderban areas South of Dampier Hodge's line, namely, Bhagatush  Khali (Rampura), Kumirmari (Bagna), Jhinga Khali, Sajnakhali, Gosaba, Amlamathi (Bidya), Canning, KuKali,  Piyali, Nalgaraha, Raidighi, Bhanchi, Pathar Paratima, Bhagabatpur, Saptamukhi, Namkhana, Sikarpur, Kakdwip,  Sagar, Mousini, Kalinagar, Haroa, Hingalganj, Basanti, Kuemari, Kultola, Ghusighata (Kulti) area. The allowance shall be admissible only upto the period for which the. Government of West Bengal continues to pay this allowance to its  employees. 

6 Scheduled/Tribal Area Allowance and Bad Climate Allowance categorised as Tough 'Location Allowance-III  shall be admissible only in those States where Scheduled/Tribal Area Allowance and Bad Climate :Allowance are  admissible and shall be discontinued in those States where it has been discontinued for the State Government  employees with effect from the date(s) of such discontinuance. 

7 In the event of a place falling In more than one category, the higher rate of Tough Location Allowance will be  applicable. 

8 Tough Location Allowances shall not be admissible along with Special Duty Allowance. However, employees  have the option for continuing Special Compensatory (Remote Locality) Allowance at old rates of 6th CPC, where it was  admissible, along with Special Duty Allowance at revised rate of 10% of Basic Pay, 

9 Employees may exercise their option to choose either Hard Area Allowance which is admissible alongwith Island Special Duty Allowance or one of the Special Compensatory Allowance, subsumed under Tough Location  Allowance as mentioned in Para 1 above, 

10 These orders take effect from 1st July, 2017. 

11 These orders shall also apply to the civilian employees paid from the Defence Services Estimates and the  expenditure will be chargeable to the relevant head of. the Defence Services Estimates. In regard to Armed Forces  personnel and Railway employees, separate orders will be issued by the Ministry of Defence and Ministry of Railways,  respectively.

Sub: Implementation of Govt. decision on the recommendations of the Seventh Central Pay Commission-Revision of Pension of Pre-2016 Pensioners / Family Pensioners etc.

Ref: This office important circular no. C-153, bearing no. G1/C/0199/Vol-1/Tech, dated 12th August 2016.


Attention is invited to above cited circular wherein all Pension Disbursing Authorities (PDAs) were advised to revise the Pension/ Family Pension of all pre-2016 pensioners with effect from 01.01.2016, by multiplying the pension/ family pension as had been fixed at the time of implementation of 6th Central Pay Commission (CPC) recommendations, by a factor of 2.57. The amount of revised pension/family pension so arrived at was to be rounded off to next higher rupee.

2. Now, Govt. Of India, Ministry of P, PG and pension, Deptt. of P&PW has issued further orders vide their OM No. 38/37/2016-P&PW (A), dated 12.05.2017, according to which pension / family pension of all existing defence civilian pensioners, who retired/ died before 01.01.2016, will be revised notionally by fixing their pay in the pay matrix recommended by the 7th CPC in the ‘Level’ corresponding to the pay in the ‘Pay Scale/ Pay Band’ and ‘Grade Pay’ at which they retired/died. This is required to be done by notional pay fixation under each intervening pay commission based on the formula for revision of pay. In this regard,DoPPW,vide,OM No. 38/37/2016-P&PW(A) dt.06.07.2017 has issued concordance table wherein pension of retirees in various pay scales existing over different periods has been indicated.

3. In terms of these orders, the higher of the two formulation i.e. pension/family pension already revised by the PDAs in terms of this office circular No. C-153. dt. 12.08.2016 (i.e. after multiplication by factor of 2.57) or the pension/ family pension as worked out in Para-2 above shall be paid w.e.f. 01.01.2016 to all pre-2006 Defence Civilian Pensioners/ Family Pensioners. Also, Corrigendum PPO, showing revised rate of Basic Pension/Family Pension to be paid w.e.f. 01.01.2016 to all pre-2006 Defence Civilian Pensioners / Family Pensioners, will be issued by this office.

4. These Corrigendum PPOs will be issued in new series of PPO No. which will contain 16 digits including suffix of 4 digits to identify pension type & nature of Corrigendum. Only electronic PPOs will be generated which will be digitally signed. No physical PPOs will be printed and sent to any agency. The new PPO will also contain a QR code wherein all important data will be embedded. This QR code may be used by PDA’s to capture the data. These PPOs will be sent to the Banks through SFTP connectivity which this office has established with various banks. Other banks, with whom there is no SFTP connectivity, are advised to immediately take necessary measures to establish the same. In the interim period till the time they establish SFTP connectivity, PPOs will be sent through email. Similarly, these PPOs will be sent to DPDOs through the CGDA WAN. Director of all treasuries are requested to kindly provide an email ID of .nic or any other domain issued by government for this purpose. A sample copy of such PPO is enclosed for ready reference.

5. PDAs are advised to affect payment based on e-PPO without waiting for any confirmation from respective HOOs. A copy of these PPOs, duly digitally signed, will also be sent through email to Head of offices (HOOs). The respective HOOs may, however check these PPOs and send a copy of the same to the pensioners/family pensioners for their record.

6. PDA’s shall make immediate modification in e-scrolls by inserting a new column (36) wherein the new PPO number containing 16 digits (including suffix of 4 digits) is indicated. In respect of those pensioners who have not been allotted new PPO number, pensioner ID(Which consists of 15 digits) if available in original /corr PPO may be captured and indicated in a different column(column no. 37).

7. Pension Disbursing Authorities are further advised to intimate the status of revision carried out by them in terms of this circular in Annexure-I enclosed herewith to Shri R.K.Sharma, SAO, O I/ C Audit Section, Office of the Principal CDA(P.), Allahabad-211014. A Consolidated soft copy of all such payment in CSV format may be sent in a CD to this office and also be mailed to the email cda-albd@nic.in

Benefits of Retirement Gratuity and Death Gratuity to the Central Government employees covered by New Defined Contribution Pension System (National Pension System) has been extended vide Govt. of India, Ministry of PPG & P, Deptt. of P&PW in their O.M. No. 7/5/2012-P&PW (F)/B dated 26.08.2016 (copy enclosed)on the same terms and conditions as are applicable to employees covered by Central Civil Service (Pension) Rules, 1972. The Ministry has further clarified vide O.M.No.28/03/2017-P&PW(B) dt. 18/05/2017, that CCS (Pension) Rules, 1972 are otherwise not applicable to the Central Government employees covered under NPS. Hence, they would obviously not be eligible for Service Gratuity or Pension under the CCS (Pension) Rules. 

2. The phrase ‘terms and condition’ in the ibid O.M. dated 26.08.2016 refers to the requirement of qualifying service, the rates on which retirement gratuity is to be paid, the limit of amount of gratuity, nominations, disciplinary provisions, etc. in the CCS(Pension) Rules. All these condition would be equally applicable for grant of gratuity to employees covered under NPS. The decision to extend retirement gratuity and death gratuity vide the O.M. dated 26.08.2016 is absolute and not provisional. Separate rules on gratuity for Central Government employees under NPS would be framed in due course. 

3. Now, it has been decided that to submit the claims of above beneficiaries for Retirment Gratuity and Death Gratuity, the following procedures shall be adopted by HOO and Pay Audit Controllers:-

i. H.O.O. will prepare a claim in case of NPS beneficiaries going to retire in accordance with the procedure as prescribed for Defence Civilian Personnel appointed before 01.01.2004 and will submit the same along with service boom and all the relevant documents (Which is required in case of pre 01.01.2004 Cases) to PAO concerned i.e.LAO/RAO. The Permanent Retirement account No. (PRAN) of the concerned Government Servant Allotted by National Security Depository limited (NSDL) will also be indicated. In cases where PRAN has not been allotted by NSDL to a NPS subscriber being non-effecting account as on 0104.2008, permanent pension account No.(PPAN) allotted to subscriber will be indicated. 

ii. PAO will carry all necessary checks with reference to the entries in service book and as admissible under the OM No.38/41/06 P&PW (A) dated 05.05.2009 (already circulated under this office circular no.79 dt. 29-10-2010) to ensure that entries made in claim are in as per records in the service book of the individual. After signing and affixing the seal, the PAO concerned i.e.LAO/RAO will pass on the claim to the PCDA(P) Allahabad. The service book will be returned by PAO to HOO concerned.

iii.HOO will also maintain a separate register for recording entries for PRAN /PPAN No., Name of Government Servant, PPO No. and awards notified.

iv. On receipt of PPO from PCDA(P) Allahabad, HOO will check the same and after recording the entries in the register retransmit PDA’s copy to PDA, Pensioner copy to Pensioner and retain
HOO copy for their own record.

v. Other procedures prescribed for pre 01-01-2004 pensioner will also be followed by the HOO in case of NPS beneficiaries.

4. In view of the foregoing, you also are requested to issue suitable instructions (along with copy of this circular) to all the Head of Offices under your administrative control to ensure that claim on the subject matter henceforth are floated in accordance with instructions given in above Para.

Sub: Difficulties being faced by the Family pensioner at the Pension Disbursing Agency (PDA) about furnishing of Non-Marriage Certificate.

Instructions for payment of family pension and submission of Non-Marriage/Re-Marriage certificates from defence family pensioners (including Defence civilian family pensioners) are provided in Para 39 of DPPI-2013 and para 12.3 & 12.4 of Scheme for Payment of Pension of Defence Pensioner by Public Sector Banks revised edn. 01.01.1987. 

Periodicity of submission of Non-marriage/ re-marriage certificate for various kinds of recipients of family pension is different. Difference in periodicity of submission of certificate was a cause of inconvenience to the family pensioners and was attracting representations from various agencies. Accordingly, the matter was referred to the competent authority to consider the periodicity of submission of Non-marriage/ re-marriage certificate for all kinds of recipients of family pension as once a year. The competent authority has advised that certificate may be sought for from the family pensioners at the time of annual identification. 

In view of the above, all the pension disbursing authorities are advised to seek submission of non-marriage certificate from all kinds of recipients of family pension at the time of annual identification (i.e. in the month of November each year).

Subject: Making available publically scores and rankings of candidates in the recruitment examinations through portal- reg.

The undersigned is directed to refer to OM of even number dated 21.06.2016 (copy enclosed) of this Department delineating the modalities for disclosure of scores and rankings of the candidates in the recruitment examinations conducted by- various recruitment agencies.

2. Now, it has been decided that all the recruitment agencies viz. UPSC, SSC, RRB etc. will use NCS portal of Ministry of Labour and Employment for disclosure of scores and rankings of the candidates.

3. All the public Recruitment Agencies are therefore requested to link their respective web pages to NCS portal (www.ncs.gov.in) of Ministry of Labour and Employment for disclosure of scores/rankings of all the candidates appearing in the final stage of each recruitment process being conducted by them.

4. All the Ministries/Departments are also requested to direct the Recruitment Agencies working under them for doing the needful in this regard.
