Subject : Introduction of Provisions for writing of APAR of Railway Employees Working in Grade Pay Rs.1800/- Level-I.

Attention is invited to Board’s letter of even number dated 30.12.2014, vide which, concept of writing APARs of those Railways’ employees working in Grade Pay Rs.1900 and in whose cases APARs were not written earlier, was introduced inter-alia mentioning that those Railway servants in Grade Pay Rs.1800, the system of working reports as and when required will continue. A proforma evolved for this purpose was also enclosed.

2. A need to introduce the system of writing APARs in the cases of erstwhile Group ‘D’ staff working in Grade Pay Rs.1800, Level-I, has been experienced considering the fact that now such employees have also been made eligible to compete with others in the scheme of LDCE and other departmental selections whenever and wherever these are conducted to fill up particular posts through departmental promotion.

3. Consequently, the matter has been reviewed. It is advised that the APARs be written in the case of all the erstwhile Group ‘ D’ employees G.P. Rs. 1800/- Level-1 in the proforma attached. The revised proforma will be applicable for APARs written from the current year (2018-19) onwards.

Sub: Comprehensive policy on Mutual Transfer of non-gazetted staff on the Zonal Railways.

Policy instructions regulating transfer on Mutual Exchange basis and assignment of seniority thereafter are contained in the Para 230 of IREC Vol.I and Para 310 of IREM Vol.I 1989 Edition. Administrative instructions for effecting such transfer(s) have also been issued from time to time. Recognizing the need to consolidate and supersede the obsolete/antiquated instructions, this circular lists out all the updated policy instructions on the subject as on date in supersession of all the earlier instructions.

2. Definition: Any Railway servant who is member of Railway services of a Railway/Division/Unit can seek Mutual transfer with the employee of another Railway/Unit/Division working in same grade or by reverting willingly and unconditionally (if working in higher/different grades) subject to provisions contained in Para 226 of IREC Vol.I.

3. Powers:- DRMs have full powers to effect Mutual transfer of divisionally controlled post. CWMs are vested with full powers for Workshop controlled posts. As regards Head Quarter controlled posts, the General Manager is competent authority or any lower authority to whom powers have been delegated.

4. Assignment of seniority on transfer on Mutual Exchange basis

4.(i) (Codal Provisions) : In such cases, the senior of the two employees will be given the place of seniority vacated by the junior employee. The junior on joining the new unit will be allowed to retain his former seniority and shall be placed into the seniority below the persons having the same seniority (Para 230 of IREC Vol.I refers).

4(ii) IREM Provisions : Railway servants transferred on mutual exchange from one cadre of a division, office or railway to the corresponding cadre in another Division, office or railway shall retain their seniority on the basis of the date of promotion to the grade or take the seniority of the railway servants with whom they have exchanged, whichever of the two may be lower (Para 310 of IREM Vol. I refers).

4(iii) Corresponding cadre:- The General Managers of the Zonal Railways themselves or the lower authority to whom powers have been delegated may decide whether it is corresponding cadres of the two employees seeking mutual transfer. (Board’s letter No. E(NG)I-2015/TR/15 dated 02.03.2016 & 4 (ii) refers).

4(iv) No backtracking once Mutual Exchange agreed:- Since mutual transfers are ordered with the consent of both the parties, it should be made clear right at the time of forwarding applications for mutual transfer that no request for backtracking from Mutual exchange arrangement will be entertained under any circumstances.

5. Community Restrictions:-

(i) Hon’ble High Court of Kerala at Ernakulam vide their order dated 07.06.2005 in O.P. No.2150/02 while partially upholding the order of CAT, Ernakulam Bench dated 31.12.2001 in OA No. 851 /1999, held that mutual transfers should be allowed between staff belonging to the same category (i.e. General with General, SC with SC and ST with ST). Subsequently in OA No.612/2005 the CAT, Ernakulam Bench directed that the Railway Board should decide the policy arising out of High Court of Kerala’s order dated 07.06.2005 referred to in this para, as expeditiously as possible.

(ii) In the light of the above, Ministry of Railways have decided that in order to maintain the balance in the post-based rosters with reference to reservations prescribed for SC and ST staff and to avoid hardship to staff in the feeder grade in the matter of their promotion, transfers on mutual exchange basis should be allowed between employees belonging to the same category (i.e. General with General, SC with SC and ST with ST). However, transfers on bottom seniority in recruitment grades need not be restricted with reference to points in the post based rosters. The procedure being followed generally in this regard to adjust shortfall/excess in future may continue. But such transfers should be allowed only repeat only against vacant direct recruitment quota posts and not against promotion quota posts. The above instructions do not in any way alter the existing procedure as laid down by this Ministry regarding operation/maintenance of post-based rosters. {Board’s letter No. E(NG)I-2004/TR/16 dated 14.08.2007( R.B.E. No.107 /2007) refers}.

6. In the context of the above instructions, the following doubts had been raised:-

i) Whether the restriction does not apply to employees belonging to OBCs as the same has not been mentioned in the instructions ibid; and

ii) Whether the restrictions on mutual transfer will apply when such transfers take place in recruitment grades.

6.1. The matter had been considered carefully and clarified item-wise as under:-

i) There being no reservation in posts filled by promotion for OBCs, the term ‘General’ should include OBCs also. In other words, staff belonging to General/OBC categories may contract mutual transfers with staff belonging to General/OBC.

ii) In view of the fact that the instructions dated 14.08.2007 do not impose any restriction on transfer on request on bottom seniority in recruitment grades, mutual transfer in the recruitment grades will also be allowed without restriction provided:-

a) The posts in the grade are entirely filled by direct recruitment from open market;

b) In case where posts in the grade are partly filled by promotion and partly by direct recruitment both the employees seeking mutual transfer should have been recruited directly from the open market; the intention being that both of them should be borne in the post based rosters maintained for direct recruitment. In other words. if one or both the employees are borne in the post-based rosters maintained for promotion, the restriction on mutual transfer as per instructions dated 14.08.2007 will apply. {Board’s letter No. E(NG)l-2004/TR/16 dated 22.10.2007 ( R.B.E. No. 134/2007) refers}.

6.2 List of Documents:- (a) The application containing all the necessary details should be made in as many copies as the level/officers through which the application has to pass through including the Unit/Division/Railway to which the transfer is sought for.

(b) All the copies should have a recent passport size photograph of the employee firmly pasted/affixed on the top-right corner of, the application.

(c) The application should be accompanied by an additional identical passport size photograph which may be affixed /pasted similarly on the Memorandum/Order sparing the employee for transfer as and when issued.

(d) The immediate supervisor/officer of the employee concerned before forwarding the application for further necessary action should attest the photograph affixed on each copy of the application in such a manner that the signature and the rubber stamp below that appear partially on the photograph and partially on the paper outside the photograph.

(e) The rubber stamp should clearly indicate the name and designation of the Supervisor/Officer attesting and forwarding the application.

(f) Each level/Office will retain a copy of the application complete in all respects as per details mentioned above before forwarding the same to the higher authority or Unit to which the transfer has been sought for, as the case may be. The particulars filled in should be checked and certified to ensure no discrepancies are there especially whether the employee is regularly promoted or on ad-hoc in that particular grade.

(g) The application should be registered and appropriate priority number allotted as per extant procedure and the employee advised of the same.

(h) After the request for transfer has been accepted and necessary orders issued by the competent authority, Memorandum/Order sparing the employee should have the photograph of the employee (received from him at the time he made the request initially) pasted on it duly attested in the manner indicated in (d) above. The Memorandum/Order should also have the signature of the transferred employee and his left thumb impression both of which should be duly attested by the officer signing the Memorandum/Order with his name and designation appearing below the signature.

(i) When the transferred employee presents himself in the new Unit with the original Memo sparing him for transfer, necessary details like his photograph, signature etc. should be carefully matched before he is allowed to join. If, in any case. the detail Is match prima-facie but still reasonable doubt persists and consultation/enquiry/verification of genuineness is warranted with the Railway/Division/Unit from which the employee has been transferred. the same can be done as soon as possible but within a month of his joining.

j) All communications regarding transfer should be signed by a Gazetted Personnel Officer with his name and designation appearing below the signature.

(k) The LPC should be issued immediately signed by a Gazetted Accounts Officer with his name and designation appearing below the signature.

(l) LPC should be sent under a covering letter to the new Unit to which the employee has been transferred through special messenger as far as possible whose identity should be established and noted at the time of accepting the document.

(m) The Service Book of the employee concerned duly completed should be sent to the new Unit in the same manner as in (l) above. {Board’s letter No. E(NG)I-2001/TR/16 dated 21.11.2001 ( R.B. E. No. 229/2001) refers}.

7. Relieving:- It has been decided that all mutual transfer cases where NOC has been given by both the Railways/Units i.e. accepting and relieving, both the employees should be spared immediately_ within a week, without either unit waiting for the reliever. A photocopy of Service Record and unvetted LPC should be given to the employee for submission at the new Division. Original Service Records/LPC should also be sent positively within 15 days. {Board’s letter No. E(NG)I-2017/TR/24 dated 09.05 .2018 ( R.B. E. No. 65 /2018) refers}.

8. No applicability of corresponding cadre in erstwhile Gr. “D” ( Rs 1800/Level-l) :- It has been decided that an erstwhile group “D” employee working in level-1 ( G.P. Rs 1800/-) belonging to any department/cadre of a division/office/railway/P.U./Unit may be allowed to go on mutual exchange basis transfer with another employee working in Level-l ( G.P. Rs 1800/-) and belonging to any department/cadre of another division/office/railway/P.U./Unit without applicability of the term “Corresponding cadre”. This dispensation is, however, subject to the fulfilment of the prescribed medical standard. The staff so transferred should invariably be imparted requisite training in the new unit wherever considered essential before putting him\her on a working post. This training period should be counted as duty. ACS No. 250 amending Para 310 of IREM Vol.I have been issued these provisions are not applicable to non-gazetted Railway employees working in Level-2 and above. {Board’s letter No. E(NG)I-2017/TR/19 dated 06.07.2018 ( R.B.E. No. 99/2018 refers}.

9. Mutual Transfer on reversion:– It has been decided that Mutual Transfers may also be permitted between staff in two different grades but only in the recruitment grade of the cadre and not in intermediate grades. Both the employees seeking mutual exchange shall have to give a written undertaking accepting reversion unconditionally and willingly in their own interest to the recruitment grade and bottom seniority in their respective new Unit in order to avoid future litigation. The expression mentioned in preceding lines, should necessarily be incorporated in the application submitted by the employee concerned. The “Note” below Para 2 (b) (iii) of Board’s letter No. E(NG)I-2017/TR/24 dated 22.09.2017 as mentioned in para 1 above stands deleted. Other terms and conditions for mutual exchange including community restrictions contained in Board’s letters No. E(NG)I-2004/TR/16 dated 14.08.2007 & 22.10.2007 remain. (Board’s letter No. E(NG)I-2018/TR/08 dated 26.10.2018 refers).

10. Model Timelines to deal with Mutual Transfer cases:-
  • (i). Forwarding of applications by Supervisors to the Personnel Department of the Division: It should be verified at the stage that the prescribed application form is complete in all respects duly signed by both employees and the information given therein is correct. In case of Workshop staff, this will be done at the Workshop itself.

(ii). Forwarding by Divisional Personnel Department:
  • (a)Divisional controlled posts:- Divisional personnel Department will forward the request application with documents directly to the Division concerned to which is sought. The name and designation of the officer letter should invariably be mentioned in the forwarding In respect of Workshop staff, this will be done Workshop Manager(CWM) or by lower authority the powers may be re-delegated.
  • (b)HQ controlled, posts :- Personnel Department will forward the application with all the necessary documents to (CPO office). 
(iii). Forwarding by HQ Personnel deptt ( For HQ controlled posts):- On receipt of the application duly forwarded from Division/Workshop, the HQ Personnel Deptt office will forward it to the Zonal Rly/PU concerned.
15 days
(iv). Conveying of acceptance:- The counter-part HQ/Division to issue their acceptance to forwarding HQ/Division ( as the case may be).
10 days
(v). Issue of Transfer Order:- On receipt of consent from the receiving HQ/Division, the transfer orders should be issued.

11. Technical assistance: -The request for Mutual Transfer should be updated electronically so that there is no opportunity to make any grievances. For this purpose use COMPTRAN soft-ware to register and monitor all the cases of Inter-Railway Transfer as advised under Board’s letter No. ERP/Portal-Transfer/2013 dated 08.08.2018.

  1. Recruitment drive will result in massive employment generation with 2,30,000 direct jobs

  3. Phase-I (starting February-March, 2019 and completed by April-May, 2020) will comprise of 1,31,428 posts
  4. Phase II (starting May-June 2020 and completed by July-August, 2021) will comprise of 99,000 posts
  5. About 34,000, 17,000 and 62,000 posts reserved for SC, ST and OBC candidates respectively. Further, as per 103rd Constitutional Amendment, 10% of these vacancies, i.e. around 23,000 shall be reserved for candidates from Economically Weaker Sections (EWS)

In line with the mega recruitment process for recruitment of 1,51,548 employees initiated 14 months ago, Indian Railways will initiate fresh recruitment of 2,30,000 more employees under various cadres of Indian Railways, which will be recruited over the next two years in two phases.

In line with the vision of Hon’ble Prime Minister, Shri Narendra Modi, Indian Railways is consistently expanding its workforce to match the manpower requirements of new projects and increase the overall efficiency of the entire railway network. These recruitment drives will fix long-standing issues of overtime work, delay in project implementation, low efficiency, and constraints on upgradation. With the increase in investment in Railways being threefold since 2014, recruitment needs have also increased, which will lead to job-led growth and expansion of Indian Railways.

Presently, Indian Railways has a sanctioned strength of 15,06,598 employees. Out of these, 12,23,622 personnel are on roll. The remaining 2,82,976 are vacant posts. Recruitment for 1,51,548 posts is going on, leaving 1,31,428 posts still vacant. Further, it may also be noted that approximately 53,000 and 46,000 railway employees shall retire in 2019-20 and 2020-21 respectively, causing an additional vacancy of approximately 99,000 employees. Thus, after accounting for the current recruitments in progress, there will be total net vacancies of 1,31,428 and approximately 99,000 i.e. approximately 2,30,000 employees in the railways over next two years.

These are proposed to be recruited over the next two years in two phases. The first phase of fresh recruitment of 1,31,328 posts shall be initiated in the month of February-March, 2019. As per reservation policy of the Government, around 19,715, 9,857 and 35,485 number of vacancies shall be reserved for SC, ST and OBC candidates respectively. Further, as per 103rd Constitutional Amendment recently passed by the Parliament, 10% of these vacancies i.e. around 13,100 shall be filled in from Economically Weaker Sections (EWS). This cycle shall be completed by April-May, 2020.

After the first phase of fresh recruitment of 1,31,328 personnel is completed, the second phase of recruitment of approximately 99,000 personnel against the vacancies arising out of retirements shall be initiated. As per the reservation policy of the Government, approximately 15,000, 7,500, 27,000 and 10,000 posts shall be reserved for SC, ST, OBC and EWS candidates respectively.

Recruitment shall be for various cadres and minimum eligibility criteria shall vary from certification from Industrial Training Institutes or Diploma/above in Engineering or Graduation in any discipline, depending on the post for which the candidate is applying.

These recruitment cycles will result in massive direct and indirect employment generation. Recruitment of 1,31,328 persons in first phase followed by recruitment of 99,000 persons shall create around 2,30,000 direct jobs. The resulting increase in efficiency and investment will boost the regional economies, while boost in connectivity through the Railways will integrate the economic potential of regions and give further rise to job opportunities for the youth of the nation.

Subject:- Change in procedure on issue/discharge of Kisan Vikas Patras (KVPs) and National Saving Certificates (NSCs).

Sir/Madam,

It has come to the notice of this directorate that the orders on the aforesaid subject issued vide the ADDENDUM to SB Order no. 06/2016 (vide this office letter of even no. dated 28.04.2017) were not being followed properly by the Circles. In some Circles the return were neither sent to the AO-ICO nor to the DAP and this important work had almost come to a halt on one pretext or the other. The ground reality is that neither the procedure prescribed in the ADDENDUM was followed nor any type of checking was done.

Seeing the gravity of the situation, the following orders are being issued with the approval of the competent authority to be followed with immediate effect:-

  1. As regards the issue & discharge of NSCs/KVPs issued on or after 01.07.2016, the consolidation and vouchures of HO & SOs should be transferred to the SBCO of the HPO concerned. The SBCO Branch will take further necessary action for proper checking, similar to that being done for other type of accounts. After checking, the SBCO will send details to DAP for final checking & further action.
  2. As regards the discharge of NSCs/KVPs issued before 01.07.2016, the details alongwith consolidation and vouchers of HO & SOs will be sent to the DAP by the HPO. The Checking and further disposal will be done at the end of DAP.
The aforesaid instructions supersede the previous instructions/orders on the Subject to the extent as mentioned against serial 1 and 2 above.

At the same time the Circles should inquire into as to why the Directorate’s instructions on the subject were not followed and the important work regarding checking and disposal of documents relating to issue and discharge of NSCs/KVPs was kept pending. Responsibility should be fixed and suitable action be taken against the delinquents. Neglect of such an important work is a serious issue.

Sub: Implementation of the recommendation of 7 CPC on Over Time Allowance (OTA)-preparation a list of those staff coming under the category of ‘Operational Staff regd.

I am directed to refer to Department of Personnel & Training’s OM No. A-27016/03/2017-Estt. (AL) dated 19.06.2018 circulated vide letter no. 52-01/2018-PAP dated 04.07.2018 on the above subject. According to the said O.M., Government has decided to discontinue OTA for categories other than Operational Staff and industrial employees.

2. As per para 1 of this OM, “Ministries/Departments to prepare a list of those staff coming under the category of ‘Operational Staff. The following definition shall be used to define Operational Staff:

"All non-ministerial non-gazetted Central Government servants directly involved in smooth operation of the office including those tasked with operation of some electrical or mechanical equipment."

3. In this regard, it is requested to prepare a list of operational staff with full justification based on the above parameters for inclusion of a particular category of staff in the list of operational staff and submit it to this office latest by 04.02.2019.

New Delhi, the 4th January, 2019.

G.S.R……… (E).– In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor-General of India in relation to persons serving in the Indian Audit and Accounts Department, the President hereby makes the following rules further to amend the Central Civil Services (Pension) Rules, 1972, namely:-

1.Short Title and Commencement:-

(1) These rules may be called the Central Civil Services (Pension) Amendment Rules, 2018.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Pension) Rules, 1972 – in rule 38, for sub-rule (1) and sub-rule (2), the following sub-rules shall respectively be substituted, namely

“(1) The case of a Government servant acquiring a disability, where the provisions of section 20 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016) are applicable, shall be governed by the provisions of the said section:

Provided that such employee shall produce a disability certificate from the competent authority as prescribed under the Rights of Persons with Disabilities Rules, 2017.

(2) If a Government servant, in a case where the provisions of section 20 of the Rights of Persons with Disabilities Act, 2016 (49 of 2016) are not applicable, retires from the service on account of any bodily or mental infirmity which permanently incapacitates him for the service, he may be granted invalid pension in accordance with rule 49:

Provided that a Government servant, who retires from service on account of any bodily or mental infirmity which permanently incapacitates him for the service before completing qualifying service of ten years, may also be granted invalid pension in accordance with sub- rule (2) of rule 49 subject to the conditions that the Government servant‑
(a) has been examined by the appropriate medical authority either before his appointment or after his appointment to the Government service and declared fit by such medical authority for Government service; and

(b) fulfils all other conditions mentioned in this rule for grant of invalid “;
(ii) in rule 49, for sub-rule (2), the following sub-rule shall be substituted, namely: –

“(2) Subject to the proviso to sub-rule (2) of rule 38, in the case of a Government servant retiring in accordance with the provisions of these rules after completing qualifying service of not less than ten years, the amount of pension shall be calculated at fifty per cent of emoluments or average emoluments, whichever is more beneficial to him, subject to a minimum of nine thousand rupees per mensem and maximum of one lakh twenty five thousand rupees per mensem.”,

सा.का.नि. ................ (अ) -- राष्ट्रपति, संविधान के अनुच्छेद 148 के खंड (5) के साथ पठित अनुच्छेद 309के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारतीय संपरीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध में भारत के नियंत्रक-महालेखा परीक्षक से परामर्श करने के पश्चात, केंद्रीय सिविल सेवा (पेंशन) नियम, 1972 का और संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात :-

1. संक्षिप्त नाम और प्रारम्भ:-

(1) इन नियमों का संक्षिप्त नाम केन्द्रीय सिविल सेवा (पेंशन) संशोधन नियम, 2018 है। 
(2) ये राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे। 

2. केन्द्रीय सिविल सेवा (पेंशन) नियम, 1972 में, -

(i) नियम 38 के उपनियम (1) और उपनियम (2) के स्थान पर क्रमशः निम्नलिखित उपनियम रखे जाएंगे, 
अर्थात :-

"(1) दिव्यंग्ता अर्जित करने वाले किसी सरकारी सेवक के मामले में जहां दिव्यागजन अधिकार अधिनियम, 2016 (2016 का 49) की धारा 20 के उपबंध लागू होते हैं, उक्त धारा के उपबंधों द्वारा शासित होगा:

परंतु ऐसा कर्मचारी दिवयंगजन अधिकार नियम, 2017 के अधीन यथाविहित सक्षम प्राधिकारी से प्राप्त दिवयांगता प्रमाणपत्र प्रस्तुत करेगा। 

(2) उस मामले में जहां दिवयंगजन अधिकार अधिनियम, 2016 (2016 का 49) की धारा 20 के उपबंध लागू नहीं होते हैं, वहाँ यदि सरकारी सेवक किसी शारीरिक या मानसिक अशक्तता के कारण, जो उसे सेवा से स्थायी रूप से असमर्थ कर देती है, सेवानिवृत्त हो जाता है तो उसे नियम 49 के अनुसार अशक्त पेंशन दी जा सकेगी:

परंतु यदि कोई सरकारी सेवक किसी शारीरिक या मानसिक दुर्बलता के कारण, जो उसे अपनी दस वर्ष अर्हक सेवा पूर्ण करने से पहले सेवा से स्थायी रूप से असमर्थ कर देती है, उसे भी निम्नलिखित शर्तों के अधीन रहते हुए नियम 49 के उपनियम (2) के अनुसार अशक्त पेंशन दी जा सकेगी-
(क) समुचित चिकित्सा प्रधीकारी द्वारा या तो सरकारी सेवा में उसकी नियुक्ति से पूर्व अथवा उसके नियुक्ति के पश्चात उसकी परीक्षा की गई और उसे सरकारी सेवा के लिए ऐसे चिकित्सा प्राधिकारी द्वारा योगी घोषित किया गया हो; और
(ख) अशक्त पेंशन दिये जाने के लिए इस नियम में वर्णित अन्य सभी शर्तों क्कों पूर्ण करता हो।";
(ii) नियम 49 के उपनियम (2) के स्थान पर निम्नलिखित उपनियम रखा जाएगा, अर्थात :-

"(2)नियम 38 के उपनियम (2) के परंतुक के अधीन रहते हुए, दस वर्ष से अन्यून अर्हक सेवा पूर्ण करने के पश्चात इन नियमों के उपबंधों के अनुसार सेवानिवृत्त होने वाले सरकारी सेवक के मामले में, न्यूनतम नौ हज़ार रुपए प्रतिमास तथा अधिकतम एक लाख पच्चीस हज़ार रुपये प्रतिमास के अधीन रहते हुए, पेंशन की रकम परिलब्धियों या औसत परिलब्धियों के पचास प्रतिशत पर संगणित की जाएगी, जो भी उसके लिए अधिक लाभदायक हो"।

Subject: Clarificatory OM for payment of two family pensions on death attributable to Govt service of a re-employed pensioner  regarding

The undersigned is directed to say that references have been received in this Department seeking clarification as to whether a second family pension is admissible under CCS(EOP) Rules when a military/civil pensioner is re-employed in civil service dies and his death is attributable to Government Service.

2 Vide this Department's Notificaton No G.S:R, 938(E) dated 27.12.2012, sub-rule 13A and 13B of Rule 54, prohibiting two family pension, have been deleted. Subsequently, vide OM No 1/33/2012-P&PW( E) dated 16 1.2013, two family pensions have been allowed in the event of death of a re-employed pensioner, in service or after retirement. The financial benefits for the past cases however is with effect from 24th September, 2012. Thus under CCS(Pension) Rules, two family pensions are admissible with effect from 24th September 2012.

3. The matter has been examined in the context of the provisions of CCS(Extra-ordinary Pension/Rules it is clarified that the provisions of two family pensions, one in respect of military/civil service and.the other for civil service after re-employment, as available in terms of CCS(Pension) Rules, is also applicable under COS(EOP}Rules. In other words. on death of a pensioner who was re-eamployed in civil service where death is attributable to government service, family pension under CCS(EOP Rules in respect of Service In re-employment would he admissible in addition to ordinary family Pension in respect of the previous military/civil service.

4 Where, however, on death of a re-employed civil Government servant, the family is eligible for Special/extra-ordinary family pension under the EQP-rules in respect of the first spell of service, family pension fer the second spell of service would be admissible under the CCS(Pension) Rules, 1972 only.

5. The extra-ordinary family pension shall be granted only in one service. In no case, both the family pension shall be granted under EOP Rules.

6. The financial benefits in the past cases will accrue with effect from 24th September, 2012, as in the case of family pension under CCS(Pension) Rules.

7. Formal amendment in Central Civil Service (Extraordinary Pension) Rules will be made in due course.

8. This issues with the approval of Department of Expenditure, vide their ID Ne 1(5)/EV/2012 dated 3/4/2017 and 15/01/2019

Subject: Payment of Dress Allowance: Civ Emp.

Consequent upon the implementation of 7th CPC, Uniform Allowance/ Washing Allowance/ Stitching Charges/Shoe Allowance etc have been subsumed in Dress Allowance. The order on the same was notified vide DoPT OM No. F. No. 14/4/2015-JCA 2 dated 31.08.2017. During the course of compliance of ibid DoPT OM by controllers, this HOrs has received several references on the below mention points:

(a) Whether, in the absence of any letter/authority from the concerned unit regarding the categories to whom the dress was supplied earlier (before 7th CPC), the Dress Allowance can also be admitted in audit for Non- Industrial person as per DoPT OM dated 31.08.2017.

(b) Whether Dangries, which is a protective cloth provided to Industrial person of MES/AOC, can be admitted in audit under Dress Allowances as per DoPT OM dated 31.08.2017. 

(c) If Dress Allowance is not admissible to the industrial personnel in MES for overall combination (Dangri), whether washing allowance which was in vogue, is to be continued or otherwise.

2. The issue has been examined at this HQrs and the following is advised:

(a) While dealing with the grant of Dress Allowance in terms of DoPT OM dated 31.08.2017 and to ascertain the categories of employees to whom the dress was supplied prior to the implementation of 7th CPC, a certificate. which includes all conditions prior to the implementation of 7th CPC, a certificate. which includes all conditions mentioned in DoPT OM dated 31.08.2017, may be obtained from the claimant unit alongwith the bills.

(b) Regarding the Dress Allowance to MES/AOC employees to whom Dangri is issued and were granted ‘washing allowance’ of Rs. 24/- per month, E-in-C branch has been approached vide this HQrs letter 25.10.2018 to provide a list of Uniforms duly classified as Basic Uniform and Special Clothing being provided to MES Employees. In response, HQ MES. vide their lette- B/20943/LIV/GEN/EIC(2)/53 dated 22 Nov 2018, has intimated that a case has been taken up with MoD regarding grant of Dress Allowance to Industrial Personnel of MES and decision/ sanction is awaited (copy enclosed). However, as regards to Gp ‘C’ and Gp D staff of MES. it has been intimated that various items of liveries were being provided to them has been stopped and they are entitled for Dress Allowance as per DOPT OM No. 14/4/2005-JCA-2 dated 31 Auc 2017. Therefore, the Dress Allowance to MES personnel may be regulated in accordance with HQ MES ibid letter.

This issues with the approval of Jt CGDA(P&W). .

l. Reference your letter No AT/II/2366/Dress Allowance/Vol-I dated 25 Oct 2018

2. It is intimated that various items of liveries for Summer and Winter were being provided to the Gp ‘C’ and erstwhile Gp ‘D’ staff (CMD, Peon, Daftry, Chow & Safaiwala etc.) of MES which has been stopped after the issue of Govt of India Ministry of Personnel, Public Grievances and Pensions, (Department of Personnel & Training) Establishment (JCA-2) Section F No. 14/4/2015-JCA-2 dated 31 Aug 2017 received vide Ministry of Defence, Deptt of Defence, D (Civ-II) ID No. 18/3/2008/D (Civ-II) dated 20 Oct 2017. Hence, they are entitle for Dress Allowance as per the directions given in ibid letter.

3. Moreover, a case regarding grant of Dress Allowance to Industrial Personnel of MES is taken up with MoD and on receipt of their decision/sanction the same will be communicated to all concerned.

In this regard a communication No 2-3/2009-Medical dated the 23rd January 2019 from Assistant Director (Medical) Department of Posts has been received vide which it was clarified that the budget for the current financial year has already been allocated to the Circles (subordinate offices) in connection with Postal Dispensaries and hence, Department of Posts agrees to bear the expenditure for the remaining part of financial year prior to merger/takeover instead of transferring the allocated budget for Postal Dispensaries to the MoH&FW. It is also requested that all necessary formalities for takeover w.e.f. 01.04.2019 may be undertaken forthwith so that beneficiaries or doctors are not put to any difficulties. In view of the above, the undersigned is directed to state that necessary action may be taken by the concerned Additional Directors of CGHS to complete the requisite formalities, so that the 33 dispensaries shall function as CGHS Wellness Centres w.e.f. 01.04.2019. The guidelines to be followed in this regard along with the list of Additional Directors under whose administrative control the 33 dispensaries shall function are enclosed.

GUIDELINES FOR THE ADDL. DIRECTORS OF CGHS TO BE FOLLOWED FOR TAKEOVER OF POSTAL DISPENSARIES BY CGHS

1. Administration / Manpower related:

(i) Meeting with the concerned local Postal Authorities for obtaining the following information /Data.
    (a) Sanctioned staff strength and the staff in position as on date.
    (b) Last Pay Certificate of the doctors and staffs available as on 28.02.2019.
    (c) Detailed list of consumable and dead stock article available as on date.
    (d) Detail of infrastructure like area, land holding etc.
    (e) Liabilities as on 31.03.2019.
      (ii) Formation of a coordination committee for merging of dispensaries:-
        A committee will be constituted with four members. Postal Authorities shall nominate two persons and two persons shall be nominated from CGHS.
        iii) Allocation of permanent advance imprest money to that dispensary

          2. Beneficiary /CGHS Card / Computerization related:

          (i) To take note of existing number of beneficiary in the postal dispensary and approximate number of pensioner beneficiaries who are likely to be shifted from nearby CGHS Wellness Centres to the newly formed dispensary may be ascertained-
          (ii) The subscription after takeover by CGHS shall be at CGHS rates and deducted from the Salary in case of serving employees.
          (iii) Action may be taken for procurement of computer, printer, Flat Bed Scanner and accessories and Leased Line Connectivity/ Telephone with Broad Band. Data Card for immediate operations may be procured, wherever they are needed.
          (iv) Necessary Electrical wiring / points and LAN wiring for computers may be undertaken. Action may be initiated for online UPS as in case of other CGHS Wellness Centres

          (v) NIC may be contacted and meeting may be organized with NIC for subsequent computerization and putting IP address of the system- User names /Pass words in consultation with NO, CGHS(MCTC)
          (vi) Areas covered under the new CGHS Wellness Centre shall be identified and notified- since it is a new WC it shall be limited to a radius of approx...5 Kms.
          (vii) Training of the staffs of Postal dispensary in receipt and entry of Data for issuance of CGHS card. 
            3. Medicines Related:

            (i) Estimate of the medicine required for those dispensaries may be ascertained based on the basis of approximate number of beneficiary in those dispensaries.
            (ii) Action may be initiated for procurement of medicines as per the guidelines prevalent and action may be taken to register with GMSD.
            (iii) The exiting local chemist of the postal dispensary may be contacted to continue to provide services on the same terms and conditions as an interim measure and approval of Directorate General of CGHS may be taken for engaging the chemist on same terms and _ conditions for six months or till finalization of new tender process, whichever is earlier. 
              4. Accommodation Related

              In dispensaries functioning in rented accommodation the owners of the building may be contacted to continue the existing agreement for at least one year and seek approval of Directorate. For revision of rent assessment by CPWD may be undertaken subsequently. 
                5. Meeting may be held with the local Pensioners’ Association and action may be taken for formation of Local Advisory Committee. 

                6. E-Tender Processes

                Action may be initiated for e-tender for appointment of Local Chemist and for outsourcing of House-keeping and Security Services. 
                  7. Empanelment of private Hospitals / Diagnostic Centres at the CGHS rates of the City of the concerned Additional Director.

                    The undersigned is directed to refer to DoE’s O.M of even Number dated 24.5.2016 on the above mentioned subject and subsequent O.M of even Number dated 10.4.2018 regarding retention of GPRA by Central Government Civilian employees (including CAPF employees) and to say that para 3 of the said O.M dated 10.4.2018 which was based on the clarification issued vide O.M dated 24.5.2016, reads as under: -

                    “It is clarified that the facility of concessional retention of GPRA at the last place of posting for Central Government Civilian Employees (including CAPF employees), and Officers of All India Services is permitted only when the allottee of GPRA is transferred to Non-Family stations from other places and is not permitted to the Central government employees who are repatriated back to his/her parent office in Non-family stations on completion of their deputation from other places.”

                    2. Various representations have since been received from officers who have joined NSG and SPG on deputation requesting for permitting them retention of GPRA for their families at their last place of posting i.e Delhi at par with other CAPF personnel keeping in view the nature of duty performed by them. The requests have been considered and it has been decided that CAPF personnel on deputation to NSG and SPG shall be extended the facility of retention of GPRA at the last place of posting for a maximum period of 3 years, as per the provision of Rule 43 of CGGPRA Rules, 2017, on their transfer to Non Family stations. Para 3 of O.M of even Number dated 10.4.2018 stands amended to this extent accordingly.

                    The undersigned is directed to refer to the Directorate of Estates O.M. of even number dated 29.03.2001, 25.05.2005, 14.11.2007, 16.06.2011, 04.01.2013 and 09.12.2015 on the subject cited above vide which civilian employees of Directorate General (Security) have been allowed to retain general pool residential accommodation at the last place of their posting on their transfer to Chakrata, Uttarakhand upto 31.03.2019. The matter has been reviewed on the basis of the position explained by the Cabinet Secretariat that Chakrata has been declared as non-family station for civilian employees of Directorate General (Security) and hardship is being faced by these civilian employees and their family members.

                    2. It has been decided by the competent authority that the employees of the Directorate General (Security) shall be eligible for further retention of entitled type of General Pool Residential Accommodation on payment of normal licence fee during the period of their posting to Chakrata, or till 31.03.2022, whichever is earlier. No further retention will be allowed beyond 31.03.2022 and the civilian employees of Directorate General (Security) posted in Chakrata will have to make their own arrangement for accommodation and vacate the general pool residential accommodation retained by them at last place of their posting after the permissible period of retention. The employees who are not vacating the accommodation after permissible period of retention will be liable to pay damages, and eviction proceedings will be initiated against them immediately for unauthorized occupation.

In this regard, all Ministries / Departments are requested to advice all CPSEs under their respective jurisdiction to ensure that 10% reservation for EWSs as per the provisions of OM dated 19.01.2019 of DoPT would be effective in respect of all direct recruitment vacancies to be notified on or after 01. 02.2019 .
                    3. As clarified by DoPT in the OM dated 19.01.2019, the detailed instructions regarding operation of roster and procedure for implementation of EWSs reservation will be issued separately . All administrative Ministries I Departments are also requested to submit Fortnightly Report in respect of CPSEs , beginning from 15.02.2019 , to DoPT as per format given in DoPT DO dated 21. 01.2019.
